AA Grapevine, Inc. values the privacy and security of the users of our Services. This Privacy Policy (Privacy Policy) applies to AA Grapevine, Inc.’s website located at www.aagrapevine.org (the "Website"), the AA Grapevine Magazine App (the “App”), AA Grapevine’s La Viña magazines, and to any other service or product where AA Grapevine, Inc. has linked to this Privacy Policy (collectively referred to as the “Services”).

The Services are made available by AA Grapevine, Inc. (“AA Grapevine”, or “us” or “our” or “we”). This Privacy Policy sets forth our policies regarding collection, use and disclosure of certain information relating to you and your use of the Services. Your use of the Services signifies your understanding and acceptance of the terms of the Privacy Policy. If you do not agree to this privacy policy please do not access or otherwise use the Services.

 

Collection of Information
We may collect personal information, such as your name, address, email address, phone number, gender, date of birth, company name, and credit card information only when you choose to provide it to us. For example, you may choose to provide us with such information when you subscribe to one of our magazines or AAGrapevine Story Archive, sign up for our email newsletters, make a purchase through the AA Grapevine online store, register an account, contact us, opt-in to receive SMS text messaging, or otherwise provide us with your personal information. 

We may also collect certain information from you when you visit or use the Website or App including information regarding your browsing, usage and interactions.  We may collect information that allows us to identify browsers and devices you have interacted with previously. The information that we collect about you may include the type of Internet browser, browser language, and operating system you use, your device’s Internet protocol (“IP”) address, access dates and times, unique device identifiers as well as hardware or operating system device identifiers (e.g., IDFA for iOS and Android ID for Android), longitude/latitude of a (mobile) device, geo-IP data, the region where your device is located, network to which your device is connected, the website you came from before, and visited after and information related to the pages you are viewing on the Services. 

 

Use of Information
We may use and disclose your information, which may include your personal information, as described herein:

  • We may use information to operate the Website and App, provide you with any specific services that you have requested, or to respond to your inquiries.
  • We may use your information to add you to our mailing lists and to send you emails from time to time. Notwithstanding the foregoing, if you are a resident of the EU or Canada, we will not send you marketing communications by electronic message unless you have expressly consented to receive them.
  • We may permit our vendors and subcontractors to access your information, but they are only permitted to do so in connection with performing services for us.  For example, and without limitation, we may (a) share your credit card information with our third party banking and payment portal for the purposes of collecting payments or otherwise to facilitate payment; or (b) share your information with our vendors to deliver, place and track orders and for other business and communications purposes.
  • We may disclose your information in connection with (a) requests from local, state, provincial or federal government or law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, this Privacy Policy, or the rights of third parties or to investigate any suspected conduct which we deem improper.
  • We may transfer your information in connection with a bankruptcy proceeding or the sale, merger or change of control of AA Grapevine or the division responsible for the services with which your information is associated.

 
Please note that if you specifically consent to additional uses of your information, we may use your information in a manner consistent with that consent. 

We may collect or create information that is not personal information such as sets of aggregate data and other generalized information, including information about browsing, usage and interactions and de-identified information. We retain the right to use and disclose information that is not personal information in any manner permitted by law.

 

Legal Basis for Processing
The legal basis for our processing of your personal information is that it is necessary for the performance and fulfillment of the contract between you and AA Grapevine and to provide you with the Services. We will also process, transfer, disclose and preserve your personal information when we have a good faith belief that doing so is necessary or permitted for purposes permitted by law. As noted above, if you specifically consent to certain uses of your personal information, we may use your personal information in a manner consistent with that consent.

 

Security
We have implemented reasonable security measures which are designed to protect information from loss, misuse and unauthorized access, disclosure, alteration or destruction. This includes encryption of credit card transactions, verification that you are on the Website, and hosting our online store on a server using industry–standard security. In addition, the order processing and fulfillment company that we use implements industry-standard security procedures. Please note, however, that no method of transmission over the Internet or method of electronic storage is 100% secure. As a result, we cannot and do not guarantee that any information stored on our servers, or transmitted to or from the Services, will be secure or free from unauthorized access. By using the Services, you acknowledge that you understand and agree to assume these risks.

 

Cookies
AA Grapevine uses cookies or similar type of file (such as clear gifs, web beacons, tags, and similar technologies that work on mobile devices) to facilitate your communication with the Services, ordering through the online catalog, to track usage, and to compile non-personal aggregate data to improve the content and efficiency of use for our Services. This information will be used to improve our Services and offerings, to better understand our users. Such data may include, without limitation, the address of the websites you visited before and after you visited the Services, the type of browser you are using, your Internet Protocol (IP) address, what pages in the Website or App you visit and what links you clicked on, the latitude and longitude coordinates of your device, the region where your device is located, and geo-IP data. Some of the information we collect may include data, such as IP address data or the identifiers associated with your device that are unique to your computer or device (e.g., IDFA for iOS and Android ID for Android). 

We use session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. Our persistent cookie remains active on your hard drive until they expire or are deleted. We may also use and place cookies on your device from our third party service providers in connection with the Services, such as an analytics provider that helps us manage and analyze usage of the Services. An example of such third party is Google Analytics, which we use to collect and analyze demographic and other information, and through which Google will collect certain information to be used according to Google’s privacy practices. If you want to stop or restrict the placement of cookies or flush any cookies that may already be on your device, please refer to and adjust your web browser preferences. By deleting our cookies or disabling future cookies you may not be able to access certain areas or features of our Services or some of its functionality may be affected. Please be advised that certain third parties that are beyond the scope of this Privacy Policy may collect information in connection with the Services.

 

Data Retention
We will retain your information for as long as your account or inquiry is active or as needed to provide you with the Services and for a reasonable time thereafter in accordance with our standard procedures or as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your personal information, we may continue to retain and use aggregate or anonymous data previously collected and/or anonymize or aggregate your personal information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.

 

Emails and Other Communications with Us
By providing your email address to us, you expressly consent to receive emails from us.  For example, and without limitation, you may receive emails from us to process your request or to contact you regarding your order or subscription. We may also send you additional AA Grapevine, La Viña or other related emails, updates, newsletters or other marketing messages from us, or to contact you regarding your participation in user surveys, to ask for your feedback with respect to the Services or existing or prospective services or to offer additional opportunities such as opt-in SMS messaging. If you wish to be removed from our email lists, you can contact us at webcoord@aagrapevine.org or “Unsubscribe” by using the link of that name at the footer of the email communication. 

Any communication or material you transmit to us by email or otherwise, including any data, questions, comments, suggestions, or the like, are and will be treated as non-confidential and non-proprietary.  Except to the extent expressly covered by this Privacy Policy, anything you transmit or post may be used by us for any lawful purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and re-posting.

 

Opt Out
If you do not want your personal information shared with any third party who may use such information for direct marketing purposes, then you may opt out of such disclosures by sending an email to us at optout@aagrapevine.org. Note that we are not responsible for removing your personal information from the lists of any third party who has previously been provided with your information in accordance with this Privacy Policy or your consent.

You may withdraw your consent to our collection, use or disclosure of your personal information at any time by contacting us as set out below.  However if you withdraw your consent, we may not be able to provide you with the Services.

Email Communications: If you create an account and provide your email address, we may send you administrative email messages as well as emails containing information about offers or goods and services that may be of interest to you. As noted above, if you wish to opt out of our emails, you may do so by clicking on the "Unsubscribe" link in the email. We will process your request within a reasonable time after receipt. Note that even if you have opted out of receiving our emails, we retain the right to send administrative emails relating to your account.

Text Message/SMS Communications: If you create an account and provide your telephone number, we may send you administrative text messages. If you opt in, we may also send you text messages about offers or goods and services that we think may be of interest to you. If you wish to opt out of such text messages, you may do so by following the "opt-out" instructions in the text message (i.e., by texting the word STOP in response to such text messages).

Push Notifications: Like many mobile applications, if you have not opted out of receiving push notifications, we may from time to time send you push notifications under certain circumstances.  If you wish to opt out of these notifications, you can change the settings on your mobile device.

Cookies and Similar Technologies. As noted above, you may opt-out of or restrict the placement of cookies on your device or remove them from your browser by adjusting your web browser preferences. Please note that cookie-based opt-outs are not effective on many mobile devices. However, on many mobile devices, application users may opt out of certain mobile ads via their device settings. Please refer to instructions provided by the manufacturer of your device to learn how to adjust your mobile device settings.

 

Do Not Track
Please note that we do not respond to or honor “do not track” (a/k/a/ DNT) signals or similar mechanisms transmitted by web browsers.

 

Third Party Services
Our Website may contain links or references to other websites or applications outside of our control. Please be aware that we have no control over these sites or applications and our Privacy Policy does not apply to these sites or applications. We encourage our users to read the privacy policies of each and every site or application that they interact with. Third parties may also use tracking technologies by or through the Services. We have no responsibility or liability for any tracking, data collection or other activities of such third parties. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications.

 

Data Access Rights
You may also request access to your personal information (if you have provided personal information to us through the Services) and information about our collection, use and disclosure of that information by using the contact information provided below.  Unless prohibited by law or legal process, you will be given access to your personal information, entitlement to challenge the accuracy and completeness of the information, and the ability to have it amended as appropriate.  You can help us maintain the accuracy of your personal information by notifying us of any changes to it. If you do not want us to retain or use your personal information, you may delete your information or contact us at optout@aagrapevine.org.

 

Children’s Information
We do not knowingly collect any personal information from children under the age of 13. If a parent or guardian believes that AA Grapevine has in its database the personal information of a child under the age of 13, please contact optout@aagrapevine.org and we will use our best efforts to remove the information from our records. 

 

Your California Privacy Rights
California Law permits our users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us by email or write to us using the information listed under Contact Information. You may also opt-out of the disclosure of personal information to third parties for their direct marketing purposes as noted in the “Opt-Out” provision above.

 

Cross Border Transfers 
If you are visiting or using the Services from outside of the U.S., please note that you may be transferring your personal information to AA Grapevine in the U.S. and other countries, the laws of which may be deemed by the European Union to have inadequate data protection. You understand that data stored in the U.S. may be subject to lawful requests by the courts or law enforcement authorities in the U.S. We may use specific contracts approved by the European Commission which give personal data the same protection it has in the EU.

 

EU Data Subject Right
Subject to local law, you may also have certain rights regarding information that we have collected and that is related to you. If you are located in the European Union with rights under the General Data Protection Regulation (“GDPR”), you have the right to withdraw previously provided consent for our processing of your “personal data” as such term is defined under the GDPR, by contacting us at optout@aagrapevine.org. Such individuals also have the following rights:

  • Right to access – This right allows individuals to obtain confirmation as to whether or not personal data concerning him or her is being processed and provides access to such personal data. It also allows individuals to request details of the processing of his or her personal data, including, without limitation, categories of recipients to whom the personal data has been or will be disclosed and the purposes of the processing.  
  • Right to rectify – This right allows individuals to rectify any inaccurate personal data about him or her.
  • Right to restrict processing – This right allows individuals to block or suppress processing of personal data under certain circumstances.
  • Right to be forgotten – This right is also known as the “right to erasure.” It is an individual’s right to have personal data erased or to prevent processing in specific circumstances.
  • Right of data portability – This right allows individuals to move, copy or transfer personal data from one place to another in a secure manner without interrupting the integrity and usability of the information.
  • Right to object to processing – This right allows individuals to object to certain types of processing, including direct marketing, profiling and providing for purposes of scientific or historical research and statistics.

If you are located in the European Union with rights under the GDPR and have any complaints regarding our privacy practices, you have the right to complain to a supervisory authority. We would, however, appreciate the chance to deal with your concerns before you approach your supervisory authority so please contact us at the address above in the first instance and we will do our very best to resolve your concerns.

 

Your Acceptance of and Changes to this Policy
By using the Services, you signify your acceptance of our Privacy Policy. If you do not agree to this Privacy Policy, please do not use the Services. We reserve the right, at our discretion to modify this Privacy Policy at any time with or without notice to you. However, if at any time in the future we plan to use your personal information in a way that materially differs from this Privacy Policy, we will post such changes here or otherwise provide notice to you as required by law.  Users are encouraged to review this Privacy Policy from time to time. Your continued use of our Services following any modification or notice of changes to this Privacy Policy means you accept any such modifications or changes.
